Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the Now or Never platform, including the website located at nowornevertrip.com, our mobile and desktop experiences, APIs, and any related services (collectively, the "Services"). By accessing or using the Services you agree to be bound by these Terms. If you do not agree, do not use the Services.

1. Who We Are

Now or Never ("Now or Never", "we", "us", or "our") is a travel discovery and deal aggregation platform. Our principal contact email for legal notices is [email protected].

2. Eligibility & Account Registration

You must be at least 18 years old (or the age of legal majority in your jurisdiction) to create an account or use interactive features. By registering you confirm that:

• The information you submit is accurate, current, and complete.
• You will maintain the security of your login credentials and promptly update any changes to your details.
• You have the authority to accept these Terms on behalf of yourself or any organisation you represent.

You are responsible for all activity that occurs under your account. If you suspect unauthorised use, notify us immediately at [email protected].

3. Our Services

Now or Never provides personalised travel discovery tools, curated destination guides, and dynamically refreshed travel deal links. We act solely as a discovery and referral service. We do not operate as a travel agency, tour operator, air carrier, or payment processor. Any bookings, payments, cancellations, or disputes arising from third-party platforms or providers are governed by the terms of those third parties.

4. Personalised Features & Geolocation

Certain functionality (including personalised deal alerts and the Vibe Guide) relies on voluntary inputs such as your selected departure airport, travel preferences, saved tags, reviews, and geolocation data. Client-side scripts may prompt you to share your approximate location to suggest nearby airports. You are under no obligation to grant access to location data; refusing may affect the relevance of recommendations but will not block access to the Services.

5. Communications & Subscriptions

During registration you may opt in to receive:

• Transactional emails required to manage your account.
• Monthly updates about new vibe guides.
• Real-time alerts about personalised deals from selected airports and tags.

You can update your marketing preferences at any time in your subscription dashboard or via the unsubscribe link in the email footer. We may also send essential service announcements that are not subject to opt-out.

6. Travel Deals & Third-Party Services

Deals shown within the Services rely on data sourced from a combination of our own databases and third-party providers, including the Amadeus travel APIs. Because availability, pricing, taxes, surcharges, baggage allowances, visa rules, and schedule changes are controlled by third parties, the listings you see on Now or Never are provided for informational purposes without guarantee of accuracy or continued availability. Always review the terms, fare rules, and privacy notices on the booking partner’s site before completing a purchase.

7. Pricing, Currency & Availability

Prices are usually shown in EUR by default, with optional currency conversions provided for convenience. Conversion rates come from the latest data stored in our currency tables and may not match real-time rates at the moment you transact. Taxes, fees, surcharges, seat selection, and baggage are often excluded from the displayed headline price. Final amounts are determined by the booking provider at checkout.

8. User-Generated Content

When you submit reviews, destination feedback, images, or other content ("User Content") you grant Now or Never a worldwide, royalty-free, non-exclusive licence to host, store, reproduce, display, adapt, translate, and distribute that content for the purpose of operating, promoting, and improving the Services. You confirm that:

• You own or control all necessary rights in the User Content.
• The content is accurate to the best of your knowledge and does not violate the rights of any third party.
• The content is lawful, respectful, and consistent with Section 9 (Acceptable Use).

We may moderate, edit, or remove User Content at our sole discretion.

9. Acceptable Use

You agree not to:

• Use the Services for any unlawful, misleading, discriminatory, or fraudulent purpose.
• Scrape, harvest, or index the Services, including by using bots or other automated methods, except through publicly documented APIs with our prior written permission.
• Attempt to circumvent rate limits, security controls, or access data that you are not authorised to access.
• Upload malicious code or interfere with the proper working of the Services.
• Reverse engineer or copy any part of the Services for competing products.

We reserve the right to suspend or terminate accounts that violate these obligations or applicable law.

10. Intellectual Property

All intellectual property rights in the Services (including the platform, templates, code, databases, graphics, trademarks, and trade names) remain the property of Now or Never or its licensors. You obtain no rights other than the limited licence to access and use the Services for personal, non-commercial travel planning. You may not remove, obscure, or alter any proprietary notices.

11. Third-Party Links & Advertising

The Services contain outbound links, advertisements, and references to third-party sites and services. Inclusion does not constitute endorsement. Third parties are solely responsible for their content and privacy practices. Any arrangements you enter into with third parties are at your own risk.

12. Disclaimers

The Services are provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, whether express, implied, or statutory, including warranties of accuracy, reliability, merchantability, fitness for a particular purpose, quiet enjoyment, and non-infringement. We do not warrant that the Services will be uninterrupted, secure, error-free, or compatible with every device or browser.

13. Limitation of Liability

Except for liability that cannot be excluded by law, Now or Never, its directors, employees, contractors, and partners shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunities arising out of or related to your use of the Services. For users acting in a business capacity, our total liability for any claim will not exceed the greater of (a) EUR 100 or (b) the total amount you paid us (if any) in the 12 months preceding the event giving rise to the liability.

Nothing in these Terms limits liability for fraud, wilful misconduct, gross negligence, or for death or personal injury caused by negligence, nor does it limit any statutory rights available to consumers under applicable law (including EU consumer protection legislation).

14. Indemnification

You agree to defend, indemnify, and hold harmless Now or Never and its affiliates from any claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your breach of these Terms, your User Content, or your misuse of the Services.

15. Suspension & Termination

We may suspend or terminate access to the Services, remove content, or deactivate accounts if we reasonably believe you have violated these Terms, applicable law, or third-party rights. You may delete your account at any time through the subscription dashboard or by contacting [email protected]. On termination, Sections 8 through 18 will continue to apply.

16. Compliance with Applicable Law

You are responsible for ensuring that your use of the Services is lawful in your jurisdiction. By using the Services you confirm that you are not subject to EU, UK, or US sanctions prohibiting such use. If you access the Services from outside the European Union, you do so on your own initiative and are responsible for compliance with local regulations.

17. Consumer Rights & Mandatory Law

If you are a consumer residing in the European Union, European Economic Area, Switzerland, or the United Kingdom, you benefit from mandatory rights under consumer protection legislation. Nothing in these Terms affects those rights. In the event of conflict between these Terms and mandatory law, the latter prevails.

18. Changes to the Services or Terms

We may update the Services, introduce new features, or revise these Terms to reflect operational, legal, or regulatory changes. If we make material changes we will notify you by email, in-app notice, or by updating the "Effective date" above. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles, except where mandatory law requires otherwise. If you are a consumer residing in the EU, you may bring legal proceedings in the courts of your habitual residence. The European Commission provides an online dispute resolution (ODR) platform at https://ec.europa.eu/consumers/odr.
